Walnut Grovez Inc ("we", "us", "our") operates Make Photos 1, a design studio, at https://makephotos1.com. By creating an account or placing an order through this website you agree to these Terms, to our Privacy Policy, our Refund & Cancellation Policy and our Acceptable Use Policy, all of which form part of this agreement. What each package includes, its limits and its price are shown on the pricing page and again at checkout before you pay. We may change prices or packages for future purchases; a change never affects a period you have already paid for.

One-time purchases

A one-time purchase is charged once, at the price shown at checkout, and never renews. There is nothing to cancel. Refunds follow the Refund & Cancellation Policy below. Charges appear on your card statement as makephotos1.com.

Recurring subscriptions

By enrolling in a recurring subscription you authorise us to charge the payment method you provide for your selected package today and automatically every 30 days thereafter, at the price shown at checkout, until you cancel. Before each renewal we email you 5 to 7 days in advance, and after every successful charge we email you a receipt, at the address on your account. Charges appear on your card statement as makephotos1.com.

Cancellation

You can cancel your subscription yourself at any time: log in and open Easy to Cancel at https://makephotos1.com/account/cancel, then confirm. Cancellation takes effect immediately: no further charges are made and you keep access until the end of the period you have paid for. You can also cancel by emailing [email protected] or calling +1 (888) 875-0960; we action emailed requests within one business day. No cancellation fee applies.

Refunds

Every charge — the first charge of a subscription, a renewal, or a one-time purchase such as the Day Pass — can be refunded in full on request within 30 days of the charge. We review requests within 2 business days; an approved refund is sent to the original payment method within 5 business days of approval and typically appears on your statement 5 to 10 business days later, depending on your bank. Delivery

Definitions

• "Make Photos 1", "we", "us" and "our" refer to Walnut Grovez Inc, the owner and operator of this website and the service.
• "Service" means the design studio described on this website and accessible through your account: the editor, your gallery of designs, uploads, brand kits, templates and the AI text and image tools. "Design" means a canvas you create in it.
• "Client" or "you" means the person or organisation using the website and the service.

Account creation

To use the service you must create an account on this website and pay the fees for the package you choose. You must be at least 18 years old. You agree to provide accurate and complete information when creating your account and to keep it up to date. You are responsible for keeping your login details confidential and for any activity under your account, and you agree to tell us promptly at [email protected] about any unauthorised use of it. We may use a third-party payment processor to take your payment; the processor's own terms apply to the payment itself. We reserve the right to refuse service, or to suspend or end an account, where we reasonably believe these Terms have been broken or that the account is being used fraudulently.

Acceptable use

You agree to use the service only as described on this website and in accordance with our Acceptable Use Policy, which sets out what the service may and may not be used for and what the limits of each package mean, including fair use of anything described as unlimited. We may limit, suspend or end an account that breaches that policy, contacting you first where it is reasonable to do so.

The service, in detail

Make Photos 1 is a browser-based design studio. After you subscribe you open the editor, start from a template or a blank canvas, add your own photos, edit the text, and download the result as a PNG, JPEG, GIF or WebM file. Designs are saved to your gallery; brand kits save your colours, fonts and logo; and, on the plans that include them, AI tools rewrite text and generate images. What each plan allows — how many designs you can hold at once, how much storage, how many AI images and AI text actions a month, how many brand kits, which templates, whether animated export is included — is listed on the pricing page and at checkout, and is enforced by the service.

• How limits count. Designs and brand kits are counted as the number you hold at once, not per month: trash a design and the slot frees up. Storage counts your uploads and AI images. AI images and AI text actions are counted per calendar month from the first of the month, not from your billing date, and are not reset by a plan change or a Day Pass. On plans marked unlimited there is no counter; our Acceptable Use Policy's fair-use rule applies. Every plan accepts files up to 15 MB each (PNG, JPEG, WebP, GIF, SVG).
• Templates. The templates offered are chosen and uploaded by this site; the selection can change over time.
• AI tools. Text actions send the text of the box you selected to the AI provider named in the Privacy Policy; image generation sends your prompt. Output may be inaccurate or resemble output given to other users, and you are responsible for checking it before you publish. Generated images carry no watermark; where a platform or a law requires AI-made images to be labelled, label them. The AI tools can be switched off by this site, in which case the rest of the studio works as before.
• Your content. You keep the rights you have in what you upload and what you design. You must own or be licensed to use every photo, logo and piece of text you upload, and you may not create or publish unlawful, infringing, deceptive or harmful material (see the Acceptable Use Policy).
• After a plan ends. Your designs, uploads and brand kits stay in your account and your gallery stays visible, but the editor and new downloads are unavailable until a plan is active again. Files you have already downloaded stay with you. A trashed design is deleted permanently after 30 days.
• Availability. The service and the AI providers behind it are provided as they are, with no uptime guarantee or service-level agreement. Support is by email at [email protected] and phone on +1 (888) 875-0960 during Mon–Fri, 9am–6pm.

Intellectual property

All intellectual property in the service, including its software, design, text and trademarks, belongs to us or our licensors. You may not copy, modify, distribute, sell or transfer any part of the service without our written consent. Content you put into the service remains yours.

Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages arising from or in connection with your use of the service, including loss of profits, goodwill, use or data, even if we have been advised of the possibility of such damages. Our total liability to you for all claims arising out of the service, whether in contract, tort (including negligence) or otherwise, is limited to the amount you paid us for the service in the twelve months before the claim arose. Nothing in these Terms limits liability that cannot be limited by law.

No warranty

The service is provided "as is" and "as available". We make no warranty, express or implied, including of merchantability, fitness for a particular purpose or non-infringement, and we do not warrant that the service will be uninterrupted, timely, secure or error-free.

Indemnification

You agree to indemnify and hold harmless Walnut Grovez Inc, its officers, employees, agents and licensors from any claim, liability, damage, loss, cost or expense (including reasonable legal fees) arising from your use of the service or your breach of these Terms.

Changes to these Terms

We may update these Terms. If a change is material we will email the address on your account before it takes effect. Continuing to use the service after a change takes effect means you accept it; if you do not, you can cancel as described above.

Entire agreement

These Terms, together with the Privacy Policy, the Refund & Cancellation Policy and the Acceptable Use Policy, are the entire agreement between you and us regarding the service.
